Many employed persons in Ontario are covered by disability insurance policies in the event they are injured or become seriously ill and cannot work.
Most policies have certain criteria the injured worker must meet in order to qualify for the benefit. These criteria are normally summarized in the disability policy manual or employee handbook.
Typically, during the first two years of the disability, the test for the disability is whether or not you are able to perform the job you were doing at the time of sickness or injury. After the initial period, the test changes. You must then show that you are unable to perform any job for which you are otherwise able to do, considering your education, training and experience. Every policy is different, however. If your benefits have been terminated, or you have been denied initial entitlement to benefits, you should speak to a lawyer immediately to help you with your claim for benefits, in order to ensure that you understand the policy provisions and your obligations under the disability policy contract.
